CONDITIONS OF SALE OF CTonKod

The following conditions of sale are agreed by Mrs.Isabelle Mazier Energetician, IM Energetician whose registered office is in St Gély du Fesc (34980), registered in the commercial register and under the number of siret 45286227900026, NAF code 8690F hereafter named "Isabelle Mazier" and secondly by any natural or legal person wishing to make a purchase via the website www.CTonKod.com, hereinafter referred to as "the buyer".

Article 1: Object

CTonKod and its products are trademarked in France and the European Union.
These conditions of sale are intended to define the contractual relationship between Isabelle Mazier and the buyer and the conditions applicable to any purchase made through the CTonKod merchant site, whether the buyer is professional or a consumer.
The acquisition of a good or a service through the present site implies an acceptance without reserve by the buyer of these conditions of sale. These conditions of sale will prevail over all other general or particular conditions particular not expressly approved by Isabelle Mazier. Isabelle Mazier reserves the right to modify these sales conditions at any time.
In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2: Characteristics of goods and services offered

The products and services offered are those listed in the catalogue published on www.CTonKod.com.
These products and services are offered within the limits of available stocks.
The photographs in the catalogue are as faithful as possible but cannot ensure a perfect similarity with the product, especially as regards the colours; moreover the products can present variations of hue within the same colour.

Article 3: Rates

Isabelle Mazier reserves the right to modify prices at any time, it being understood that the price listed in the catalogue on the day of the order will be the only one applicable to the buyer.
The prices quoted do not include transport and delivery costs provided that they take place in the geographical areas specified below.
For any order to FRENCH OVERSEAS DEPARTMENTS AND TERRITORIES and countries outside the European Union, the possibility of a fee to be paid at customs clearance cannot be ruled out. To know the current rate, we invite you to inquire at your customs. Prices are firm and final when validating the order. The buyer must verify that the total price of the order corresponds to his expectation; otherwise the buyer must not make his order. No discount related to transport, VAT, customs fees or the price of items will be made after validation of the order.
Purchases made via this website are subject to value-added tax (VAT) at the rate legally in effect on the day of the sale.
If we detect an error in the price of the product(s) you have ordered, we will inform you as soon as possible and offer you either to confirm your order at the correct price, or to cancel the order. If we fail to contact you, the order will be considered cancelled and we will refund the full amount paid.
We are not required to sell a product at an incorrect lower price (even after you have received an Order Confirmation), if the error is clear and unambiguous and you are reasonably able to identify it as such.

Article 4: Geographical area

The online sale of CTonKod products and services presented on the www.CTonKod.com website is reserved for buyers residing in France and in the European Community.

Article 5: Orders

The buyer through the site (the Consumer), who wants to buy a Tee Code (10 copies maximum), or Professionals : Distributors and Resellers, from 11 copies, a specific quote will be issued at the request, and must :

Any request for return must be made within a maximum of 14 calendar days (date of receipt of the parcel), after this time, we will not be able to take into account your request.
A - For Individuals
In accordance with Article L121-20, buyers, non-professional individuals, have a cooling-off period of 14 calendar days from the receipt of their order to return the product to the seller for refund without penalty, excepting the cost of return. In accordance with Article L121-20-2, the right of withdrawal cannot be exercised on goods made according to the specification of the consumer.
For all orders whose volume does not correspond to the normal use of an individual (more than 10 items), the return conditions applicable to professionals will be used.
B- For Professionals
In the case of a return of merchandise granted to a company, 15% of the amount for management fees will be deducted.
Warning: T-code items that have been altered or personalised are not affected by the withdrawal period and cannot be resumed. All items to be returned must be returned in their original packaging under the same conditions as those in which they were shipped. The right of withdrawal is not applicable for goods that have been unsealed which cannot be taken back for reasons of hygiene.

Article 7: Respect for intellectual property rights

In the case of an order for items to be personalised, the buyer assures Isabelle Mazier that the visuals and texts used are free of rights of third parties.
In case of claim for violation of the rights of a third party, the buyer will release Isabelle Mazier of any responsibility. The buyer is entirely responsible and will have to repay Isabelle Mazier for all the damages incurred.

Article 8: Retraction

Buyers, non-professional individuals, benefit from a 14-day cooling-off period from the delivery of their order to return the product to the seller for a refund without penalty, with the exception of return fees, for business customers 15% of the amount for management fees will be deducted. Article 10: Terms of payment

Article 12: Branding

Branding is not part of the CTonKod business.
The branding will be taken into account by the Customer or the Distributor himself upon receipt of the goods.
However it can be done by us on special request of the Consumer, Professional and Reseller by mail or mail with discount graphic chart and a minimum order of 2,000 CTonKod. In case of branding by us:
12.1 The buyer undertakes not to provide brandings whose contents contravene the laws in force in the countries concerned in matters of intellectual property, defamation, pornography, infringement of morality, protection of children, incitement to racial hatred and any other theme related to respect for the human person; in general, the buyer undertakes not to infringe the rights of any third parties.
12.2 An order is definitively taken into account only when all the elements of branding are validated by our services. In case of non-feasibility the buyer will be contacted by Isabelle Mazier to find a solution or to cancel the order.
12.3 The inscription dimensions are given for information only and may be modified, at the discretion of the manufacturing operator, according to the visual provided, the cut and the size of the CTonKod products.
12.4 Isabelle Mazier does not guarantee a perfect correspondence of the colors of branding compared to the visual provided by the buyer.

Art 13: Liability

The total and cumulative liability of Isabelle Mazier, whatever the cause, is limited to the amount paid by the buyer to Isabelle Mazier under the order concerned. In no event shall Isabelle Maziers indirect and / or immaterial or moral damages, namely financial or commercial losses such as loss of profit, loss of orders, loss of exploitation, loss, be compensable by Isabelle Mazier.
Data, loss of profit, damage to the image, interruption of service, as well as damages of the same nature resulting from an action in claim against Isabelle Mazier by the buyer due to damage suffered by a third party. Isabelle Mazier will archive the purchase orders and invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized records of Isabelle Mazier will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Article 17: Dispute Resolution

The present conditions of sale on line are subjected to French law.
